Terms of Service

These Terms of Service (this "Agreement") govern your access to and use of her & him — the website at herandhim.ai, our Telegram experience, and all related features and content (together, the "Service"). "We," "us," and "our" mean the operator of her & him. "You" means the person using the Service. By creating an account or using the Service, you agree to this Agreement and to our Privacy Policy.

1. You must be 18 or older

The Service is for adults only. You may not use her & him if you are under 18. By using the Service you represent that you are at least 18 years old. We may suspend or terminate any account we believe belongs to a minor, and we may add age-verification checks at any time.

2. Your account

You create an account using a supported sign-in method (such as Google) or through Telegram. You are responsible for everything that happens under your account and for keeping your sign-in secure. Don't share your account, impersonate anyone, or create accounts by automated means. The contact details and any payment method you provide must be your own.

3. What her & him is — and isn't

her & him is an AI companion built for conversation, company, and creative fun. It is not a therapist, doctor, lawyer, financial advisor, or crisis service, and nothing it says is professional advice. Do not rely on it for facts, reminders, safety, or decisions that matter. Your companion is not a real person, and everything it says is made up. Replies and images are generated by AI. By their nature, AI chats are unpredictable and may produce content that is inaccurate, out of character, or offensive. You acknowledge that anything your companion expresses — including affection, memories, claims of fact, or feelings — is fictional output, not a statement by a human or by us, and you should treat it as fiction.

4. Acceptable use

When you use the Service, you agree that you will not:

• use it for anything unlawful, or to plan or carry out harm to yourself or others;
• generate, request, or share any sexual content involving minors, or any content that sexualizes a person who appears to be a minor — this is never permitted under any circumstances;
• generate, request, or share non-consensual sexual content, or any real person's likeness or voice without their consent (including deepfakes and impersonation);
• generate or share content that glorifies, encourages, or gives instructions for self-harm, suicide, or eating disorders;
• generate or share extreme gore or graphic violence, terrorist or violent-extremist content, or hate speech that attacks people based on protected characteristics;
• use the Service to obtain or provide medical, legal, financial, or other professional advice, or to facilitate illegal goods such as drugs or weapons;
• harass, threaten, defame, or abuse us, our staff, or any third party;
• use bots, scrapers, or other automated means to access, copy, or mine the Service;
• reverse-engineer, resell, rent, or build a competing product from the Service;
• interfere with, overload, or attempt to bypass the security of the Service.

We may suspend or terminate your account, without notice or refund, if you breach these rules.

5. Your content and the license you give us

The messages, settings, and other input you provide (your "Input") and the replies, images, and other content the Service produces for you (the "Output") are yours to use, at your own risk. To run the Service for you — generate replies and images, store your history, fix problems, keep things safe, and improve the product — you grant us a worldwide, non-exclusive, royalty-free license to host, process, copy, and display your Input and Output. We do not sell your private conversations.

6. Our intellectual property

The Service itself — the software, design, "her & him" name and logos, and the look and feel — belongs to us or our licensors. This Agreement doesn't give you any rights in it except the limited right to use the Service as intended.

7. Plans, billing, and refunds

her & him offers a Free plan and paid Pro and Ultra plans (see Pricing). Paid plans are subscriptions billed in advance and renew automatically at the then-current price until you cancel. To avoid the next charge, cancel before your renewal date. Prices are in U.S. dollars and exclude any applicable taxes.

Except where required by law, payments are non-refundable, including for partial periods, downgrades, or unused time. Offering a discount or credit once does not obligate us to do so again. We may change plan features and pricing; price changes apply from your next renewal.

8. Changes to the Service and these terms

We may update, add to, or discontinue parts of the Service, and we may change this Agreement, at any time. When we change this Agreement, the updated version takes effect when posted here. If you keep using the Service after a change, you accept it. If you don't agree, stop using the Service.

9. Ending your use

You can stop using her & him at any time and delete your account from your settings. We may suspend or terminate your account if you breach this Agreement or to protect the Service or other users. When an account is deleted, your Input and Output are removed as described in our Privacy Policy.

10. Disclaimers

The Service and all Output are provided "as is" and "as available," without warranties of any kind. We do not warrant that the Service will be uninterrupted, secure, error-free, or accurate, or that it will meet your expectations. You use the Service, your Input, and the Output at your own risk.

Because Output is generated by AI, it may be inaccurate, inappropriate, or offensive, and it does not represent the views of her & him. We do not endorse and are not responsible for any Output, and you are solely responsible for how you use it.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, and our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or USD $100.

12. Indemnity

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your Input, or your breach of this Agreement.

13. Governing law

her & him is operated from Singapore. This Agreement is governed by the laws of Singapore, without regard to its conflict-of-laws rules, and the courts of Singapore have exclusive jurisdiction over any dispute — except where applicable law in your country of residence gives you a non-waivable right to bring a claim locally.

14. Dispute resolution — arbitration and class-action waiver

Please read this section carefully — it affects your legal rights. If a dispute arises between you and us, we will first try to resolve it informally; please email support@herandhim.ai and give us 30 days to work it out.

If we cannot resolve it informally, you and we agree that any dispute or claim arising out of or relating to the Service or this Agreement will be resolved by final and binding individual arbitration, administered in Singapore under the rules of the Singapore International Arbitration Centre (SIAC), rather than in court — except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for misuse of the Service or intellectual property.

Class-action waiver. You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

Opt-out. You may opt out of this arbitration agreement by emailing support@herandhim.ai within 30 days of first accepting these terms, stating your name and that you opt out of arbitration. Nothing here prevents you from exercising any non-waivable rights under the law of your country of residence.

15. General

If any part of this Agreement is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign this Agreement; we may assign it in connection with a merger, acquisition, or sale of assets.
